Terms & conditions of use

The website provides access to a number of services which may be used in accordance with these Terms.

• The purchase of fabrics from our exclusive collections for which we retain the copyright and image creator rights.
• The possibility of sending us your designs or digital images so that we can print them for you.
• The possibility of ordering image products that have been affixed to objects and fabrics and other products.

To do this:

• You are responsible for ensuring that all information submitted at checkout is accurate and complete, so that we can provide you with purchases made. This information includes in part but is not limited to: name, address, phone number, email address, payment information.
• Once you have placed an order for goods or services through the Couture & Violette Textiles website, the order will not be deemed to have been accepted until you receive confirmation from us. This confirmation will be emailed to you.
• The decision whether or not to accept an order from you is at our discretion and we are under no obligation to do so.
• We may, at our sole discretion, refund all or part of the payment made for the relevant order, but we reserve the right to invoice in full as if the products had been dispatched.

Prices and discounts

• We set the prices and display these prices on the website. Delivery costs are shown separately. From time to time we may change our prices at our sole discretion. Changes will be posted on the website.
• Any changes to your order may result in additional charges. We will contact you by email or phone to process the payment.
• Promo codes may be released from time to time as part of a promotion. Promo codes can get you a discount, free item, or free shipping.
• Promo codes can only be used for online orders placed through this website. A maximum of one promotional code can be used per order.

Modifying or canceling your order

• Within 1 hour of order: We wait a minimum of one (1) hour before launching into production after you place your order. During this hour, you are invited to contact us by phone or email if you wish to modify your order or if you change your mind.
• After one (1) hour: we manually print each product and fabric, therefore as soon as we start production or cutting your personalized items or our exclusive collections, it becomes impossible to cancel the order or request a refund.
• You agree that in order to achieve better results, we sometimes need to edit the images and adapt them in order to achieve the best possible results. Couture & Violette Textiles will attempt to communicate with you but is not obliged to make these adjustments and does so without liability, in order to obtain better results.
• If we need to communicate with you to ensure a good result before proceeding with the production of your coorder, and you do not answer our calls and/or messages, this may delay your order. If we contact you with questions about your order, it is because we believe it is necessary to provide the Service. We are not obligated to contact you about your order at the time of production.
• Please note that we cannot add discounts or promotional codes retroactively. This should be done automatically at the time of purchase or not at all. If you forgot to add your promo code when you placed your order, we won't be able to do it for you afterwards.

Product production

• Production times are an estimate and do not guarantee that products will be produced and shipped on a specific date. We will do our best to meet these deadlines.
• All fabric sizes should be exact, however due to the nature of the products (hand made and customized one by one) there will sometimes be slight shrinkage and size differences between the finished fabric and the sizes advertised on this site.

Delivery

• For more information and to see the conditions, please consult our delivery section.
• Delivery times are quoted in good faith. When a delivery time is mentioned, it only serves as an indication and we do not guarantee that the products will arrive on the precise date. We will do our best to meet these deadlines.

Returns

• In the unlikely event of a manufacturing defect, it will be repaired or replaced free of charge.
• Manufacturing defects cover scratches on the product, seam problems and hemming. We, the manufacturer, will decide what falls under manufacturing defects.
• Inquiries or complaints must be reported to us within 24 hours of receipt of the goods, or in the case of non-delivery, within a reasonable time of the expected arrival of the goods.

Reproduction of site content

• You are not authorized to copy, distribute, modify, tamper with or use in any way the content of the Couture & Violette Textiles website.
• You are advised to keep backup copies of all material provided to us. It is your responsibility to keep backup copies of any images you have added to the site or emailed to us.
• We will not be responsible for the saving or loss, deletion or corruption of images or any other material.

Data protection

• The personal data provided to us via this website will only be used in accordance with the use for your purchases. By providing us with your personal data you consent to their use only for the good of your sending and payment.
• By sending us your designs on the site you grant the following licenses: the right to display and share data for the confirmation of the right products to launch in production and the right to print.
• You also grant us the license and the right to make changes to your design if deemed necessary in order to properly prepare the item for production.

Representations

• You are the owner of the pattern or design you want printed for you; and You have the legal right to use the images sent and allow us to use the printing licenses; and To your knowledge, no one else claims ownership or exclusive rights to the Design; and The images, designs do not infringe the privacy, fame, moral or other rights of third parties.
• Couture & Violette Textiles does not encourage copyright theft. By sending your creations, images, design for personalized printing, you claim to be the rights holders and thus release Couture & Violette Textiles from all liability. In case of doubt, and after brief verification, Couture & Violette Textiles may at any time terminate production without refund.
